Commercial law is a special private law applying to merchants and traders. To this end, the German Commercial Code (HGB) contains norms that supplement or amend the general regulations of the German Civil Code (BGB) whenever merchants and traders are involved in legal transactions. In addition, unwritten commercial customs may apply, as deriving from the tradition of commercial transactions. Commercial law also includes all types of distribution law (commercial agents, brokers, and authorised dealers) as well as franchise systems. As part of our commercial law practice we also advise our clients on all aspects of commercial contract law.
