Administrative and Constitutional Law

Administrative law regulates the relationships between government bodies (such as authorities) and citizens and companies. It comprises legal norms that concern the actions of the administration, administrative procedures, and the legal status of citizens in their relationships to the administration. In this context authorisations, public building law, environmental law, and subsidy law often feature prominently.
Constitutional law deals with the fundamental legal principles, structures and institutions of a state as laid down in its constitution. It stipulates the separation of powers, fundamental rights, the organisation of state power, and the legal relationship between the state and its citizens.

Protection against unauthorised administrative action

The state interferes with the constitutionally guaranteed freedoms of companies and citizens in many respects, at best in compliance with the existing legal limits. Where this is not the case, or where the question of the scope of the legal restrictions on state action is unclear or needs to be redefined, we advise our clients on the question of whether and to what extent a judicial review of state action is promising. At the same time, we explore whether and to what extent there may be alternative but equally effective ways for our clients to behave that can simultaneously exclude a conflict with the state institutions.
